While a breach of database security and confidentiality can be harmful or embarrassing to the data collector, both the agency and the employee responsible for the breach can be found legally liable for a Privacy Act violation. This legal liability can include civil liability for the agency and criminal liability for an agency official. Civil liability for such a breach attaches when the agency has acted in a manner which was intentional or willful. The federal judiciary has interpreted this phrase to require a showing of fault somewhat greater than gross negligence. 48 Similarly, criminal liability, in the form of a misdemeanor, attaches for such a breach when an officer or employee of an agency, who by virtue of his employment or official position, has possession of, or access to, agency records [covered by the Privacy Act], and who knowing that disclosure of the specific material is so prohibited, willfully discloses the material in any manner to any person or agency not entitled to receive it . Likewise, criminal liability can attach when an officer or employee of any agency willfully maintains a system of records without meeting the notice requirements of [the Privacy Act]. 49 In implementing any biometric applications that fall under the Privacy Act, the agency must meet all of the Act s many requirements. Additional Safeguards The Computer Matching and Privacy Act of 1988 amended the Privacy Act by adding new provisions regulating federal agencies computer matching practices and placing requirements on the agencies. A computer match is done by using a computer program to search an agency s files for information associated with or indexed by a personal identifier, such as a name or SSN. The information thus obtained can then be compared with information in the databases of another federal agency. In this way, discrepancies and inconsistencies might be discovered that point to fraud in government benefits, for example. DOD participates in approximately 25 computer matching programs with various different government agencies. For example, DOD has a Debt Collection matching program in effect with the Department of Education. The purpose of this program is to identify and locate federal personnel who owe delinquent payments on certain programs administered by Education. For all of its matching programs, a government agency must meet the Computer Matching Act s requirements, which basically include entering into formal agreements with the exchanging agencies, verifying independently the accuracy of data received before any official action is taken, providing notice in the Federal Register prior to conducting or revising a computer matching program, and establishing a Data Integrity Board to monitor implementation and compliance with the Act.

The paging file is temporary storage used by the operating system (OS) to hold program data that does not fit into the physical RAM of the server. The ratio of physical memory to paged memory is the most important factor when determining the size of a paging file. When configuring the paging file, follow these guidelines: A proper balance between physical memory and paged memory prevents thrashing. Verify that more memory is in physical RAM than paged to disk. For optimal performance, this ratio should be approximately 3:1. Place the paging file on its own disk controller or on a partition that is separate from the OS, application, and user data files. If the paging file must share a partition or disk, place it on the partition or disk with the least amount of activity. To prevent disk fragmentation of the paging file, always set the paging file initial size as the same as the maximum size. The optimal size of a paging file is best determined by monitoring the server under a peak load. Set the paging file as three to five times the size of the physical RAM, and then stress the server while observing the size of the paging file. To conserve resources, set the paging file to a value slightly larger than the maximum utilized while under stress. If the server is short on physical RAM, use the paging file to provide additional memory at the expense of performance.

Smaller and more affordable trenching machines made such installation nancially viable. 2.231 Aerial construction methods have de nitely undergone evolutionary changes. From a labor-intensive manual operation to modern hydraulically operated lift trucks with hydraulically operated drills, saws, and hoists, present-day construction practices have drastically improved. Some old-timers remember climbing the poles and boring through a pole with a bit brace and ship s auger. Nowadays a person is lifted up the pole in an aerial basket. The pole is drilled in about a minute and the through-bolt washers and nut are installed in another minute, enabling many more poles to be framed in a day. Such ef ciency did not result in many cost reductions because of higher costs for equipment and more experienced operators, but a lot more plants could be built in a shorter time frame. Pole-line hardware also improved over the years and more attention was paid to the effects of dissimilar metals on corrosion. Therefore, better materials were introduced. Usage of corrosion-resistant materials such as a Monel metal, stainless steel, and a variety of plastics produced a more reliable cable plant. 2.232 Underground cable plant construction in both methods and materials has changed more than aerial plant. First, the method of placing the plant underground has certainly progressed from pick and shovel methodology. Opening a trench has changed from a backhoe machine to a chain-type trencher that opens a narrow trench, spilling the removed earth into a neat row along one side of the trench. Usually stones are manually removed and a layer of gravel is placed in the bottom of the trench. A trench of this variety can be used with direct burial cable.
